What Will It Take For Texans To Realize That Their Rights To Privacy Are At Stake?

We have been warning Texans for years about the threat that the Smart Grid and the Smart Meters (Advanced Meters) present to their freedom and their Constitutional Rights under the Fourth Amendment of the Constitution of the United States of America.  Why are Texans still not listening?
Is everyone so comfortable with what the Texas legislature and the various Texas agencies are doing that they actually believe that the bureaucracies have our individual rights protected?  We can attest to the fact that they do not!  While there are a few representatives and senators who are trying to help Texans protect their rights, there are so few of them that without the average Texan’s help and input, they cannot push for our safety and protection.  Every Texan should be EXTREMELY concerned!
We know that discussing or learning about how the Public Utility Commission of Texas works is pretty boring, but it is of utmost importance that every Texan understands what is at stake.  While most people cannot fathom a possibility of any risks to the public’s health from the meters, there is proof that the adverse health effects are real and that many Texans are suffering from those effects!  If you cannot wrap your head around the health issues, there is overwhelming proof that the smart meters are invading your privacy!  Even the Energy Industry is now admitting that our privacy is being invaded and they are telling us that their ability to turn our appliances on and off is happening all the time.  They also admit that hackers can and do hack into our computers via appliances like refrigerators.
Our technology is changing at such a rapid pace that the average consumer cannot keep up with how the new technology infiltrates our homes, our jobs, our towns and cities, and our entire lives.  The time is now for every Texan to stand together against the infringement upon our privacy rights!  Texas is the key to undoing the damage that our current administration has done to the entire country!  Our stand here will affect every American!

Opt Outs and Timelines

Centerpoint Energy’s opt-out is now available and has sent out the opt-out forms to the customers that have sent in their intent to opt-out.  If you have not done this you will not receive the form.  You need to contact Centerpoint Energy at 713-207-3434 to make arrangements and have them send you that form.

Oncor’s Non-Standard Meter tariff will be implemented in mid-July after and a customer will be able to receive non-standard metering service after signing an acknowledgement letter and providing a one-time upfront payment.  A monthly charge will also be billed to you through your Retail Electric Provider.  To request additional information, contact Oncor after July 17th at 1-888-313-6862.

Search for a Golden Cage

A small but growing number of people claim to suffer from electromagnetic hypersensitivity, more commonly known as EHS. The condition causes people to feel sick in the presence of the electromagnetic waves that emanate from virtually all modern electronics.

Anything from a cell phone tower to a wireless router to a refrigerator can trigger feelings of nausea, dizziness, heart palpitations and even rashes on the skin, according to the World Health Organization. People who say they suffer from EHS can feel sick merely from the presence of a nearby cell phone.

Anti-Smart Meter Groups Heading to Washinton to Rally Against Mandatory Smart Grid

Stopsmartgrid.org, the People’s Initiative, and many other anti-smart meter/grid groups are travelling to Washington D. C. June 23-27 to meet with members of Congress in a show of opposition to mandatory smart grid!  Texans Against Smart Meters is requesting that people contact their representatives and senators to open the doors to these activists and hear their story.  If you are interested in assisting the group with setting appointments, please read the whole message below to see how to set appointments and who we will agree to meet with.  Also, if you are interested in travelling to Washington D. How This Group Formed

We organized a mass torte lawsuit against the utilities in the state of CA and on May 31st of 2013, served both Edison and PG&E lawsuits for health effects from smart meters/smart grid.  About a month later, PG&E’s Congressional rep., who also happened to be an ex-lobbyist/consultant for PG&E, filed a bill in Congress to make smart grid mandatory in the US, thus placing our lawsuits in potential serious jeopardy. The Telecom Act states that environmental issues cannot be considered regarding placement of cell towers and the FCC says there are no health effects whatsoever from the radiation that wireless devices and infrastructure emit.  So should a bill pass similar to the Telecom Act, we would have very little recourse in terms of fighting this roll out.  I sent out an email asking for help fighting this in Washington and much to my relief, received an overwhelming amount of support from people!  I thank you from the bottom of my heart for that and we are now ready to take this fight to Washington.

When Are We Going?

Last week in June. 23rd-27th.  I am arriving the Sun. evening before and you might want to do that too if you will be with us on Mon.

Who Are We Wanting to Meet With?

Today we went over on our conference call some of the things that Jim Turner of Swankin-Turner law firm – who will be working with us in DC, went over with me a couple of weeks ago.  Basically, we want to meet with the committees that are funding this program.  These committees are called Appropriations Committees and there are sub-committees within these appropriations committees.  Below are links to both Appropriation Committees on the House and Senate side.  If it just so happens that your personal representative sits on one of these committees, Hallelujah!!  That will give us a better shot at obtaining the meeting! Do not be fooled by names like Agriculture committee or Rural Development…these committees with these benign names have obtained some of the most smart grid/meter funding out of everyone!!  So any Appropriations committee is the right committee for us!!  :)  Chairs of the committees are A#1 first choice, but really anyone on the committee would be great.  Also of course Energy and Commerce Committee, Energy and Power, Telecommunications, all of these and then some!!  The list of committees we should meet with is probably all of them, but with focus on these committees.

Also, we should meet with both of your representatives, your congressman/woman and your senator even if they do not happen to sit on an appropriations Committee.  We should also meet with them if they are leaving their post this November as they may be able to help us with referrals and other special things they may not have been so willing to do had they been up for re-election.

Who Do I Book Appointments With?

Ideally we would meet with the congressman/woman or senator themselves.  Second to that would be their Legislative Director or Chief of Staff.  Also good would be their Attorney or even Legislative Aide as sometimes when it’s a really big legislator they have specific aides for specific issues, such as health, etc.  No appointments with interns please!!  It is going to be hard to resist getting an appointment in an office we are trying to get into, but if they are only giving us their intern, we should not take the meeting.  It just means that legislator wants absolutely nothing to do with us and we should try and get them voted out if we can!

What Do I Say to Get the Appointment?

Look at their background…where do their interests lie?  Is there any common ground in what they are naturally involved in or in the groups that they work with or that support them and what we are doing?  If so, this is a good angle to take.  For instance with Dianne Feinstein, she has recently been spied and then lied to about it by the CIA.  So our angle with Feinstein will most definitely be the invasion of privacy issue.  There are other less obvious examples such as what other issues have they worked on maybe something with children or cancer related or something related to fraud, finances or companies ripping people off.  So simply tell them the name of the group you are with, you can say StopSmartGrid.org or you can say the name of your own local group and that you are working in association with us and then say we are organizing a trip to Washington on the issue of smart meters and smart grid and would like to have a meeting with the senator or congresswoman (always aim for the top) to explain what your own personal story or grievance is or the consumer side of smart meters/smart grid and what the problems with this program are.  You can send them a link to our paper if you like…we created it to be used as a tool to help us in these meetings.

Logistics

Please Try and Book all Senate appointments on Mon. and Tues. and all House appointments Wed., Thurs. and Fri.  The reason for this is the lay of the land.  The buildings are far apart and sometimes we could have 3 minutes between appointments but it will take 10 or 15 minutes to get from the house to the senate, so it just makes logistics easier.  If this strategy proves to be unworkable, we can always take morning appointments in the senate and afternoon in the house or something like that.  But keeping them separated into chunks of meetings on one side or the other is a good idea.  Once you have booked the meeting, please email me saying who we are meeting with, what time and at what address.

Setting the Record Straight: A Message Concerning A Board Change!

Shar, it is with great reluctance that we make this posting. Your attacks make it necessary that we defend ourselves.

Your abrasive personality makes it hard to be a friend and coworker. However, we tried to work with you for a common cause, but your remarks to other individuals also involved in the cause had reached the point that other individuals in the cause began asking why we were associated with you. To make matters worse, you claim that others in the cause have made statements about us that we have verified to be false. Only you know why you find actions of this type necessary. We each have built our reputations on being truthful in all our dealings with others, whereas you have not done this.

We only wish the best for you in your future endeavors. Any additional comments made in the public media following this posting will be taken as a sign of just how vindictive you have become.

History of TASM: On August 8, 2012 a phone conference with several citizens concerned with smart meters was organized by Sharlyn Wall aka Patriot Shar. That day we formed a board of directors consisting of five members including Patriot Shar, John Tweedell, Justin Padgett, and two others. During that meeting we had proposed various names which included, among others, Texans Against Smart Meters and Texans United Against Smart Meters. We were to think about the various names and get back to the group. I, Justin Padgett, thought for branding purposes that Texans Against Smart Meters was a catchy name after it was proposed by an “advisory member” that was in attendance on the call. I had been working on a website already as I had been asked to do an interview the previous month by Jaie Avila of WOAI in San Antonio who mentioned the lack of presence on the internet in Texas regarding a smart meter site. I surprised the group the next call and said I would be happy to continue building that site and we could use it as our message platform even though a website wasn’t originally discussed. Shar wanted Texans United Against Smart Meters to be the name. That is why just recently our heading changed from that because of our branding which I worked hard on which was Texans Against Smart Meters. The intellectual property of the site is mine that I give to ALL Texans at my discretion. During our very first meeting Shar graciously stated that this wasn’t her group, that if at any time any of us were out of line, we operated as a board and we could vote any particular member out, including her. We have done this along the way as people have not been able to give of their time at various points. Those are tough decisions boards sometimes make. We value those that have served.

Our mission for this group was to unite all groups and individuals regarding the smart meter issue. We feel that this mission has been lacking and there has been one obstacle recently and that has been Shar. I have had several conversations with her personally regarding her abrasiveness toward others and how we need to have a professional tone moving forward. Due to some comments made in public using our name and several things we have heard from others and reconfirmed by our own board members, we realized she was not operating in the light. We have had to make a tough decision and ask her to resign. I appreciate her work that she has put toward this cause, but the tough question that we asked each other was, “Is she walking her talk,” and the answer was unanimously “no” to all three board members. This wasn’t a hijacking of her organization. How many articles do you think she has written? It has taken an entire team to run this organization. In fact she was absent for six months doing work for Texas Nationalist Movement. While it is honorable to serve in other capacities, during that time she was not to be found while John and I were left holding the lion’s share of the work responding to people. To be clear, the domain name is owned by me as well as the email addresses that I have supplied at no cost to the group. At no time have I received money or compensation for the mail service, website, article writing, hosting, DVDs provided or materials. I have put thousands of hours into this organization and thousands of dollars and have never asked for any reimbursement. I consider Shar a sister and the things that have been said about me are hurtful and many things are not true. I understand the pain of being asked to resign, but we think it is necessary to move forward in a positive manner. My faith has been put to question, my character has been assassinated, and this is my response. I am hopeful she can operate in a supportive manner for the cause. I wish her the best. TASM Test Case Will Pave Way for Pilot Program for ALL Texans to Fight Back Against Smart Meters

East Texas Residents, Kevin and Monica, have been communicating with TASM (Texans Against Smart Meters) since January of this year.  They have been laying the groundwork as our test case for a pilot program to be rolled out later this year by TASM so that all Texans who do not wish to have these smart meters will have a method and means to do so.  We are eagerly awaiting the outcome of their smart meter battle.  They are true activists and the following words tell their story!

“Smart meter articles have graced my computer screen and a sense of “phew, at least we don’t have to worry about those things” always came to mind after reading them.

Then one morning, gazing out into our backyard, a smart meter attached to our house caught my eye, bringing immediate shock to my brain. How could this happen? I did not receive any notice in the monthly energy bill; no letter, nothing. The smart meter just appeared.

The next day, Monica (my wife) and I researched ways to protect ourselves from being spied upon and forced to have unwanted radiation spewed into our home. In that effort to defend our safety, health, and privacy we sent SWEPCO/AEP (the power company) a demand notice giving them 30 days to remove the smart meter, and replace it with a safe analog meter.

The same day SWEPCO/AEP received the notice they sent a young man to our home attempting to calm the crazy people. To them, obviously we were crazy and needed to be fed the company’s talking points of how safe, secure, efficient, blah blah blah, and how they do not retain or gather personal information. After I escorted the robot to the door, he let me know that they will not change the meter and if we do so, then the power to our house will be cut off.

30 days expired and our default notice was immediately sent. To summarize the default notice, it made clear that we have never and do not ever intend to steal power, reminding them we had never been late paying our bill, among many other legalities, including informing them that a licensed electrician was going to replace our meter.

We sent the electric monopoly their meter back. Several days later my wife called explaining that SWEPCO/AEP had cut the power to our house without any formal notification. When I arrived home, the normal site of our well-lit 1895 Victorian home off the small town square of Marshall, Texas, was dark. The darkness appeared to be a hole in the town inviting any thug, thief, vandal, or the like to come on in. There is nobody home here and certainly no operating alarm system.

Today was the first full day of no electricity, which means no hot water, our food will ruin in the freezers, and now the lack of light invites malcontents. All this evil occurred because we simply wished to protect ourselves from unwarranted and unlawful meters.

The local officials in government talked to the monopoly and their talking points worked well. The Mayor said, “Well Kevin, they said the meters aren’t smart meters and they’re safe.” So that’s the end of the help from the government here in happy roll over sleepy town Marshall, Texas, zombie land.

After sending the government the manufacturer’s website, which details how these meters are of the smart variety, the local government said I should get legal council because they just can’t do anything.

These officials can ticket me, fine me for all sorts of reasons, give monopolies permission to radiate and invade my privacy. However, they can’t, rather will not, re-enforce a citizens right to protect him/herself by opting out of having a dangerous spy attached to the citizen’s home.

So for now, we wait on unreturned phone calls from every politician including Ted Cruz. Although US Senator John Cornyn’s office actually answered the phone telling me bluntly, “Our office can’t get involved with anything like this. This matter is of a personal nature between a private person and another business. Unfortunately we can’t help.”  I think my tone was less than polite when I responded with something not suited for repeating even in this article.

Luckily we have wonderful family that has taken us in like wet puppies out of the cold. We will, however, fight and fight hard for our right, and our neighbor’s rights, to opt out of being forced to accept these meters invading us. Please wish us luck friends, into the breach we go again. And good luck all of you!”

URGENT: Action Needed! Attend Your Local Precinct Conventions

Please be a part of the process and attend your precinct conventions.  Many of the conventions around the state are March 4th after the polls close.  This is the time that your voice matters in shaping what is on your party’s platform.  We have a SMART METERS RESOLUTION that you can present at your local convention.  Please make six copies and take them with you to your local precinct convention.  If you are not sure where these are, contact your local County Chairperson or precinct chairperson.  Also, attend your resolutions committee at your County and or Senatorial convention.  It is important to make sure the process is transparent and you have your resolution advance to the state convention.  .

The National Highway Trafic Safety Administration is in the process of finalizing its 2014 – 2018 Strategic plan and because of that is taking comments for the next 2 days! 
 
Please take the time to formulate a brief comment about the dangers of automating vehicles using wireless technology due to increased exposure to RF radiation – a possible carcinogen, impaired driving abilities, and let us not forget to mention what an access restricting move this would be – totally in violation of the ADA.  
 
It has gotten hard enough for many people to leave their homes, but each vehicle having a transmitter would make it almost impossible, especially if they were unable to get a vehicle without a transmitter themselves.  I have been unable to find a more formal way to make a comment on this upcoming policy.  I think it is important for them to hear what a bad bad idea this is from the standpoint of public health and safety.  Hopefully this will not be the only chance to do so.
 
Here is the statement soliciting public comment, which leaves us a great opportunity for commenting on putting transmitters in every car, or even any car – “The National Highway Traffic Safety Administration (NHTSA) is currently finalizing its 2014-2018 strategic plan, and announces that it will hold a public listening session to solicit public comment on emerging or potential traffic safety problems and solutions. Public feedback will assist the agency in preparing to meet the challenges it faces in the next 5 years on improving motor vehicle and traffic safety in the United States. This notice invites comments, suggestions and recommendations from all individuals and organizations that have an interest in motor vehicle and highway safety, consumer programs (e.g., fuel economy, vehicle theft, odometer fraud, tire performance) administered by the agency, and/or other NHTSA activities. Overview of Dewhurst Meeting with TASM Regarding Smart Meters

On February 6, 2014, at the request of Texans Against Smart Meters (TASMs), the Lt. Governor called an information gathering meeting with his staff and four Texas Public Utility Directors.   This hearing resulted in a second interim charge being called. 

There were several purposes for asking that the meeting be called:

  1. To present a line-by-line rebuttal of the December, 2012 PUC commissioned report written by Alan Rivaldo and funded by the Department of Energy with a $3 million grant.
  2. To determine the impact of the erroneous and outdated Rivaldo report that has now been spread  all over the United States, Canada and British Columbia.
  3. To discuss the disputed health issues in the Rivaldo report.
  4. To discuss the on-going “punish me” outrageous tariffs being asked for by the utility companies, which we all know are totally illegal due to the NON-mandated legislation.
  5. To discuss the coming opt outs:  When they commence and the reason that Texans Against Smart Meters oppose.
  6. To request an immediate moratorium and independent study as per the mission statement of Texans Against Smart Meters.

Recap of what Texans Against Smart Meters was able to accomplish:

Educate the Lt. Governor and the four PUC Executive Directors regarding most recent medical data regarding the negative health effects of smart meters and how it contradicts the Rivaldo report using:

  1. Two-minute segment of the live blood analysis research shown in “Take Back Your Power” Documentary.
  2. The American Academy of Environmental Medicine’s October, 2013 Report which recommends a moratorium on Smart Meters.
  3. Testimony from several people regarding strange incidents since installation of smart meters, either on their home or all around them.  Some other cases were shared, such as an urgent case of a person with a wound that will not heal since moving into a home fitted with a smart meter.  Report and pictures will be presented on the upcoming follow-up visit with the Lt. Governor.

Educate the Lt. Governor and PUC Executive Directors regarding the Opt Out Program that Austin Energy rolled out to one million users in November, 2013.

  1. It was recommended the state Opt Out Program fees NOT be passed on to consumers.
  2. If an Opt Out fee is put into place, it is recommended the PUC not exceed Austin’s cost structure ($75 initiation fee, and $10 monthly fee). 

The Lt. Governor stated that he was releasing a statement that he had appointed an “overseeing” of the procedures as well as the fees being addressed, which I am glad to report has resulted in Center Point’s offering a settlement the day after our meeting.

A CD with multiple documents and letters, as well as a copy of the DVD, “Take Back Your Power,” which just last week won Top Transformational Film for 2013, were presented to the Lt.  Governor.  One of the PUCT directors requested a copy of the DVD, which was given to him also.

Texans Against Smart Meters is appreciative to the Lt. Governor for his openness, transparency and genuine concern for the health and well-being of the people of Texas.  I watched as he intently listened to the facts and challenges that day, and I saw a genuine concern about getting to the bottom of the health issues.   He stated, “I do not want to keep having to revisit this issue of possible health issues.  I have already called an interim charge to address this in 2012.  I don’t know if these meters are causing these symptoms, but we need to find out.” 

The Lt. Governor did, in fact, call an interim charge in September, 2012 at the request of Texans Against Smart Meters that resulted in a Senate hearing chaired by Senator John Carona two weeks later.  There was also a request by David Simpson to Joe Straus, Speaker of the House, which as usual was totally ignored.  I know for a fact that Lt. Governor Dewhurst has also visited with the PUCT numerous times since the 2011 onset of my networking with him on this matter. 

Now keep in mind that although Mr. Dewhurst is a business owner, is all over Texas weekly with his re-election campaign, as well as being a husband and father, he is still doing his job as Lt. Governor of Texas.   I know for a fact that many of the legislators that are campaigning have put their election first and do not seem to have the time to meet regarding issues of concern such as this one.

Briefing with Lt. Gov. Dewhurst

Lest there be any doubts:    This means “Smart Meters”:
Business & Commerce: METERING INFRASTRUCTURE. Lt. Governor Dewhurst asked the committee to monitor the implementation of advanced metering infrastructure to ensure minimization of utility customer costs. He also instructed the committee to analyze developments and make recommendations regarding the health effects and privacy implications of the advanced metering infrastructure.
TASMs had a very productive meeting with the Lt Gov & Texas PUC yesterday.  Stay tuned for a report coming soon!
